These Terms & Conditions ("Terms") govern your use of witkowskiadvisory.com (the "Site"), including its free tools, Insights, AI assistant, and consultation scheduling, all provided by Collins 2022 LLC, doing business as Witkowski Advisory Group ("Witkowski Advisory Group," "we," "us"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. Services
The Site provides information about our automation, AI agent, and business development consulting services. Consulting work is performed only under a separate written agreement, which controls over these Terms for that work.
2. Not investment advice
Content on the Site, including the Portfolio Allocation Analyzer, the Momentum Screener, Insights, newsletters, and the AI assistant, is for educational and informational purposes only. Projections and results are hypothetical, depend on assumptions, and are not guarantees. Nothing on the Site is investment, legal, tax, or accounting advice, or an offer or solicitation to buy or sell any security. Using the Site does not create an advisory, fiduciary, or client relationship. Past performance does not predict future results. The views expressed on the Site are those of Evan Witkowski personally and do not represent the views of any employer or other organization.
3. AI assistant
The Site's chat assistant is an automated AI system. It can make mistakes and is not a substitute for professional advice. Do not enter confidential or sensitive information into the chat. See our Privacy Policy for how chat data is handled.
4. SMS Terms
Program description. Collins 2022 LLC, doing business as Witkowski Advisory Group uses text messages to send operational alerts to its owner when a website visitor requests a consultation or asks a question the AI assistant cannot answer. We do not send marketing text messages, and we do not send text messages to website visitors or clients. If we begin sending text messages to anyone else, we will update these Terms first and obtain consent before any message is sent.
Message frequency. Message frequency varies with the number of inquiries received.
Message and data rates may apply. Standard message and data rates from your mobile carrier may apply to any text message you send or receive.
Opt out and help. Reply STOP at any time to stop receiving text messages. Reply HELP for help, or contact us at the email address below.
Carriers. Mobile carriers are not liable for delayed or undelivered messages. Consent to receive text messages is not a condition of purchasing any service.
Privacy. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. See our Privacy Policy.
Owner enrollment. Alerts are sent only to the business owner. The owner enrolls by texting ALERTS from his own mobile phone to (312) 766-9506. Nobody else is enrolled or texted.
5. Acceptable use
You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping it at a volume that burdens it, submitting unlawful or harmful content, or using the AI assistant to generate abusive or deceptive material.
6. Intellectual property
The Site and its content, tools, and design are owned by Witkowski Advisory Group or its licensors and protected by law. You may view and use the Site for your own business and personal purposes, but may not copy, resell, or redistribute it without our permission.
7. Disclaimers
The Site and its tools are provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy, completeness, availability, and fitness for a particular purpose.
8. Limitation of liability
To the fullest extent permitted by law, Witkowski Advisory Group will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or reliance on the Site or its tools.
9. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Illinois.
10. Changes
We may update these Terms from time to time. The effective date above shows when they were last changed. Continued use of the Site after a change means you accept the updated Terms.
